TERMS OF SETTLEMENT This Civil Miscellaneous Appeal has been filed by the claimant aggrieved by the award of a sum of Rs.3,28,100/- (Rupees Three Lakhs Twenty Eight Thousand and One Hundred only) by the Tribunal for enhancement.
2. During the pendency of the Appeal, the Insurance Company arrived at a settlement with the Appellant/Claimant thereby, the Appellant/Claimant have agreed to receive a sum of Rs.1,70,000/- (Rupees One Lakh and Seventy Thousand Only), in full quit, apart from the amount awarded by the Tribunal.
3. The second respondent/Insurance Company is directed to deposit the enhanced sum within a period of eight weeks from today (11.02.2023).
4. On such deposit, the Appellant/Claimant is entitled to withdraw the entire amount agreed now. Consequently, connected miscellaneous petition, if any, is closed.
