..Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents to consider the representation dated 20.02.2024 and to appoint a committee to inspect the width of the road from Manapakkam to Adhanur near vandalur and Consequently to pass appropriate orders to extend the existing width of the road in all places by atleast 40 feet for public safety issues. Mr. K. Karthik Jagannath, Government Advocate Order (Order of the Court was made by The Chief Justice) The petitioner seeks a direction from this Court to the authorities to widen the existing road from Manappakkam to Adhanur near Vandalur and consequently direct the respondents to provide proper modification of traffic to avoid accidents.
2. There is no averment in the petition that the narrowed part of the road is lesser than the standard minimum width prescribed in the road construction manual. Therefore, the grievance of the petitioner appears to be that because of the increased traffic, there is a need for widening of the road.
3. Learned State Counsel, upon instructions, would submit that expansion of road width is not found to be feasible because, on one side of the road there is a water channel and on the other side there is a lake. Therefore, for the purpose of widening of the road water body cannot be allowed to be affected.
4. We leave it to the authorities to work out whether it is possible to provide any other alternative road connecting Manappakkam and Adhanur. No direction can be issued for widening of the road as it would adversely affect the water bodies on either side of the road.
