The petitioners, who were arrested and remanded to judicial custody on 28.01.2023 for the offences punishable under Section 489(D) of IPC, in Crime No.46 of 2023 on file of the respondent police, seeks bail.

2. The case of the prosecution is that, on receipt of the secret information about transportation of counterfeit currency notes, the respondent and his team conducted a vehicle check up, during which, they found that the accused were in illegal possession of 1400 counterfeit currency notes, in their Bolero Car bearing registration No.TN-28-BE-8841. Hence the case.

3. Learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are illiterate persons involved in agricultural activities and they are no way connected with the alleged offence. He also stated that the co-accused has been granted anticipatory bail by this

Court. He further submitted that the petitioners are in custody from 28.01.2023 and they are ready to abide by any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail to the petitioners.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioners along with other accused were found to be in illegal possession of 1400 counterfeit currency notes in their car. He further submitted that investigation in this case is at preliminary stage, therefore, he vehemently opposed to grant bail to the petitioners.

5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

6. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and also considering the fact that investigation is at initial stage, this Court finds

that this case needs a detailed investigation. Therefore, this Court is not inclined to grant bail to the petitioners.

7. Accordingly, this Criminal Original Petition stands dismissed. 27.02.2023 ham
