Writ Petition filed under Article 226 of the Constitution of India, praying for Writ of Mandamus directing the respondents 1 and 2 to handover the petitioners 2nd semester mark sheet, 6th semester mark sheet and Provisional Certificate for the B.Com (Banking Management) Course degree to the petitioner within a time frame that may be fixed by this Court. The petitioner seeks for a direction to the respondents 1 and 2 to handover her 2nd and 6th semester mark sheets and Provisional Certificate for B.Com., (Banking Management) Course to the petitioner.

2. Mr.R.Gophinathan, learned counsel appears for the 3 respondent. Though, notice was served on the 1st and 2nd respondents, they have not chosen to appear either in person or through counsel. Their names are printed in the cause list today.

3. It is stated by the petitioner that she joined the first respondent college on 08.07.2013 and successfully completed B.Com (Banking Management) Course during April,2016. It is further submitted that she passed in all the exams in all the subjects and the 2nd respondent has also issued Transfer Certificate on 30.04.2016. However, the 2nd & 6th semester mark sheets and provisional certificate of the petitioner for the said course are still retained by the College without having any valid reasons. It is further stated that though the petitioner has made representation on 07.04.2017 for return of the mark sheets, the respondents have not taken any steps so far.

The learned counsel for the 3rd respondent, based on instruction, submitted that 3rd respondent University has already issued the provisional certificate of the petitioner to the first respondent College and therefore, it is for the said College to issue the same to the petitioner. The College has not come forward to state before this Court as to why the said mark sheets and provisional certificate of the petitioner are not given to her so far, inspite of receipt of notice in this writ petition. Therefore, this Court is left with no option except to accept the contention raised in the affidavit filed in support of the writ petition. Accordingly, the respondents 1 and 2 are directed to return the 2nd and 6th semester mark sheets and the provisional certificate for the B.Com (Banking Management) Course to the petitioner within a period of two weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs.
