PRAYER : Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the respondent to refund an amount of Rs.30,00,000/- (Rupees Thirty Lakhs) to the petitioner which was paid to the land lease deposit at ELCOSEZ - Vadapalanji - Madurai with applicable interest of 12% per annum from the date of letter of cancellation dated 08.08.2017 issued by the petitioner, within the period stipulated by this Court.

O R D E R

The petitioner has come up with this writ petition seeking a direction to the respondent to refund an amount of Rs.30,00,000/- (Rupees Thirty Lakhs) to the petitioner with applicable interest per annum, Pursuant to the cancellation of lease between the petitioner and the respondent by considering the letter of the petitioner dated 08.08.2017. https://hcservices.ecourts.gov.in/hcservices/

2. According to the learned counsel for the petitioner, the petitioner has approached the respondent vide letter dated 08.08.2017, for the same relief as prayer for in the writ petition. Since no action was forthcoming, the petitioner approached this Court by this writ petition.

3. Mr.M.Vijayan, learned counsel taking notice for the respondent, submitted that the respondent may be directed to consider the petitioner's letter dated 08.08.2017 and pass orders in accordance with law.

4. Having regard to the submissions made by the learned counsel on either side and also taking into consideration the limited prayer sought for in the writ petition, this Court directs the respondent to consider the petitioner's letter dated 08.08.2017 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as any of the interested parties, within a period of six weeks from the date of receipt of a copy of this order.

5. Accordingly, this writ petition stands disposed of. No costs.
