ORDER
The petitioner as well as the defacto complainant have entered into a joint compromise memo and filed the joint compromise memo dated 19.08.2015. Both the parties had agreed that the proceedings in C.C.No.2879 of 2011 on the file of the learned Chief Metropolitan Magistrate, Egmore, Chennai may be quashed. The memorandum of compromise reads as follows:
The First Party shall file in the Hon'ble Madras High Court a petition for quash of C.C.No.2879 of 2011 pending before the learned Chief Metropolitan Magistrate, Chennai and the Second Party shall file necessary affidavit stating no objection for quashing the said C.C.No.2879 of 2011 against the first party and also state no objection in allowing the quash petition of the other accused in the said case. Before disposing of these quash petitions the First Party shall pay the aforesaid balance amount of Rs.10,00,000/- to the Second Party.
2. In view of the specific understanding between the parties, I am of the view that the proceedings need not be continued in C.C.No.2879 of 2011 on the file of the learned Chief Metropolitan Magistrate, Egmore, Chennai.
3. Hence, the Criminal Original Petition stands allowed. The proceedings in C.C.No.2879 of 2011 on the file of the learned Chief Metropolitan Magistrate, Egmore, Chennai are quashed. The Joint Memo of Compromise shall form part of the order.
