ORDER
This Writ Petition has been filed to direct the respondents to consider the petitioner's representation, dated 11.06.2025 seeking for pathway rights in the property morefully disclosed in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court.
2. The petitioner claims that since there is no proper access to the petitioner's property, he will have to be granted pathway rights in the property morefully disclosed in the affidavit filed in support of this writ petition. Under those circumstances, the petitioner had given a representation 11.06.2025 to the respondents. Since the said representation was not considered by the respondents till date, the petitioner has filed this writ petition.
3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents. He has placed on record the written instructions received from the 3rd respondent stating that there is already a pathway available to the petitioner to reach his property and therefore, there is no necessity for the petitioner to seek for pathway rights through Page No.2 of 6
his representation dated 11.06.2025. He would also submit that a final order will be passed based on the petitioner's representation dated 11.06.2025 within a time frame to be fixed by this Court.
4. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.
5. For the foregoing reasons, this Court directs the 3rd respondent to pass final orders, on merits and in accordance with law, on the petitioner's representation, dated 11.06.2025 seeking for pathway rights, within a period of eight (8) weeks from the date of receipt of a copy of this order by adhering to the principles of natural justice. If aggrieved by the final order, liberty is also granted to the petitioner to challenge the same in the manner known to the petitioner under law. Page No.3 of 6
6. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
