Respondent PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to modify the condition imposed on the petitioner in Crl.M.P.563 of 2025 dated 06.02.2025 passed by the Principal Special Court under EC & NDPS Act, Chennai. O R D E R
This petition has been filed to modify the condition imposed on the petitioner in Crl.M.P.No.563 of 2025 by the Trial Court, while granting bail to the petitioner.
2. The petitioner was arrested and remanded to judicial custody on 07.05.2024. Initially, the petitioner was granted bail on condition that the petitioner shall execute two sureties (one of which should be a blood related surety). Since the petitioner is hailing from Odissa, there is no one available here to stand as a surety from his family. Therefore, the Trial Court modified the condition, stating that one of the surety should be a Government servant. However, this condition has also not complied with by the petitioner, since the petitioner could not able to bring any Government servants to stand as his surety. The petitioner also filed an undertaking affidavit, stating that his parents cannot travel from Odissa to Tamil Nadu, due to financial constraints.
3. Considering the above, the condition imposed on the petitioner in Crl.M.P.NO.563 of 2025, dated 06.02.2025 passed by the Trial Court is modified to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties, each for a like sum to the satisfaction of the Court. All other conditions imposed by the Court shall remain unaltered.
