2. In these proceedings i.e., in the application, parties are referred to by their respective ranks in the main suit for the sake of convenience and clarity.

3. Main suit is at a fairly advanced stage. In this scenario, learned counsel on record for plaintiff Mr.K.Harishankar who is before this Commercial Division along with Ms.Mithreyi Kasthurirangan in his usual fairness made an endorsement in the captioned application and a scanned reproduction of the same is as follows:

4. To be noted, Ms.Durga V Bhatt, learned counsel for defendant is before this Commercial Division.

5. The aforementioned endorsement is reiterated in the hearing. It is further to be noted that the captioned application is a typical 'Attachment Before Judgment' ['ABJ'] application.

6. In the light of the endorsement and reiteration of the same in the hearing, captioned application is disposed of as closed albeit preserving he rights and contentions of the plaintiff for coming up with a similar/same prayer on the same cause of action if the need arises in the days to come. There shall be no order as to costs.
