13.02.2024 during the pendency of the appeal before the first respondent challenging the order cancelling the quarry permit granted to the appellant for five years since 07.07.2022 and quash the same and thereby direct the respondent No.1 to dispose the appeal of the petitioner.

O R D E R

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus to call for the file relating to the notice issued by the fourth respondent dated 13.02.2024 during the pendency of the appeal before the first respondent challenging the order cancelling the quarry permit granted to the appellant for five years since 07.07.2022 and quash the same and thereby direct the first respondent to dispose the appeal of the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner applied for quarry licence and vide proceedings of the Deputy Director of Mining and Geology, Thirupur District dated 07.07.2022, the petitioner was granted quarry licence for a period of five years, however, the third respondent vide order dated 15.05.2023 2/4

cancelled the licence granted to the petitioner and hence the petitioner filed appeal before the first respondent and the same is pending. Whileso, the fourth respondent has passed the impugned notice. Hence, this Court may without going into the merits of the case, issue direction to the first respondent to dispose of the appeal filed by the petitioner within a reasonable time frame and till the disposal of the appeal, the respondents may be directed to defer the impugned notice issued by the fourth respondent dated 13.02.2024. 3.

Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to dispose of the appeal filed by the petitioner within a period of twelve weeks from the date of receipt of a copy of this order. Till the disposal of the appeal, the respondents are directed to defer the impugned notice issued by the fourth respondent dated 13.02.2024. The writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
