ORDER
This writ petition has been filed seeking for issuance of patta in favour of the petitioner for the property morefully described in the prayer to this writ petition, based on his representation dated 12.07.2022. Since the said representation has not been considered till date, he has filed this writ petition.
2. A counter affidavit has been filed by the third respondent and in the said counter affidavit, it is stated that the petitioner is not entitled for patta as prayed for in this writ petition. But, however, the petitioner has filed documents before this Court and categorically contends that the petitioner is entitled for patta as per the supporting documents. On the other hand, the third respondent in his counter affidavit stated that the property for which patta is sought for is classified as 'Anadheenam land', and therefore, the petitioner is not entitled for patta.
3. Since the aforesaid representation of the petitioner was not considered by the respondents, this Court is of the considered view that no prejudice will be caused to the respondents if the aforesaid representation dated 12.07.2022 is considered on merits and in accordance with law, after hearing objections from the neighbouring land owners and any other party whom the third respondent deems fit to enquire, within a time frame to be fixed by this Court. __________Page 2 of 4
Accordingly, this writ petition is disposed of by directing the third respondent to pass final orders on the aforesaid representation of the petitioner on merits and in accordance with law, after hearing objections from the neighbouring land owners and any other party whom the third respondent deems fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the aforesaid representation of the petitioner. No Costs. 08-01-2026 RKM To
