ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.11.2025 for the alleged offences punishable under Sections 5(1) r/w 6 and 11(3) r/w 12 of POCSO Act, 2012 and 351(2) of BNS Act, 2023 in Crime No.26 of 2019, registered on the file of the respondent police, seeks bail. 1/4

The allegation against the petitioner is that he was staying alone in a general hostel where several students were also residing and, taking advantage of the loneliness of the boys, he committed various kinds of sexual assault and also aggravated penetrative sexual assault. Totally 9 victims have lodged the complaint against the petitioner. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 15.11.2025 and that he has been falsely implicated due to previous enmity and instigation by certain persons. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that statements of all nine victims have been recorded and that the statements disclose disturbing allegations, including commission of penetrative sexual assault. Hence, he opposed to grant bail to the petitioner.

5. This Court on perusal of the FIR and the statements of the victims, finds that the materials disclose various disturbing facts including the way in which the petitioner had committed penetrative sexual assault on some of the victims.

6. Considering the facts and circumstances of the case, the nature of the 2/4

allegations, filing of the final report, and the fact that there are nine victims in this case, this Court is of the view that if the petitioner is released on bail, there is a likelihood of interference with the trial proceedings. Hence, this Court is not inclined to grant bail to the petitioner.
