ORDER
The above Writ Petition has been filed for the following reliefs:- "directing the 1st and 3rd respondents to consider the petitioners representation dated 10.07.2025 and further directing to conduct appropriate disciplinary enquiry against Thiru.Authimoolam, Government Teacher, Government Higher Secondary School, Manali and to pass necessary further order or orders which this Honble court."
2. This Writ Petition is a sheer abuse of process of Court.
3. The petitioner seeks action against his father-in-law (Mr. N. Authimoolan), the 4th respondent herein, who is a Government Teacher. The
complaint arises out of marital discord between the petitioner and his wife, allegedly due to the constant interference of the said Authimoolan in the petitioner's matrimonial life.
4. The petitioner's contention is that the said Authimoolan had interfered in his matrimonial life, exerted undue influence on his wife, and acted to the detriment of his minor daughter. Though the conduct complained of is in a personal capacity, according to the petitioner, it amounts to misconduct unbecoming of a Government servant, thereby attracting Rule 20 of the Tamil Nadu Government Servants' Conduct Rules, 1973.
5. The petitioner would submit that his wife and child have been forcibly separated from him and despite attempts to bring them back, the father-in-law has been a stumbling block. Therefore, he had sent a detailed representation dated 10.07.2025 to the respondents 1 to 3 to take action against his father-inlaw under Section 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules. However, no enquiry has been initiated on the same. Hence, the present writ petition has been filed.
6. Heard the learned counsel on either side.
7. The allegations that have been made are matters that have to be resolved before the appropriate forum and not by invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. The petitioner is attempting to put pressure on his father-in-law by seeking departmental proceedings against him. The petitioner, who claims that his wife and daughter have been separated from him, has not stated in his affidavit whether he has taken steps to file an application for restitution of conjugal rights or to seek custody of his daughter. Without exhausting the available remedies, the petitioner has rushed to this Court.
8. Therefore, this Court finds no merit in this Writ Petition and the same is accordingly dismissed. No costs.
