Respondents Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of mandamus directing respondents 1 to 3 to forbear the 4th respondent from doing quarrying operation in S. No.359 & 360 at Mugalur Village, Hosur Taluk, Krishnagiri District and to protect the petitioner's green house and vermin comport unit and also public of Mugalur Village at large.

2. When the matter is taken up today, Mr.J.Ramesh, learned Addl. Government Pleader takes notice for the respondent and submits that the official respondents have not received any application for grant of licence for quarrying from the 4th respondent and, therefore, it is submitted that the present writ petition seeking issuance of a writ of mandamus is premature and, therefore, the same need not be entertained.

3. Further to the above submission, learned counsel appearing for the petitioner submits that the statement made by the learned Addl. Government Pleader may be recorded and the matter may be disposed of.

4. In view of the categorical submission made on behalf of the official respondents that no application has been filed by the 4th respondent for quarrying, this Court is of the view that the present writ petition cannot be entertained as the same is too premature. In view of the above, this writ petition is dismissed as premature.
