O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4) and 132 of BNS, 2023 and Section 15, 15(3) of Indian Medical Council Act, 1956 in Crime No.291 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 19.11.2025, based on an information received from a decoy, the Joint Director of Health Service Department conducted a raid in Sri Sakthi Clinic located at the Orathi Main Road, Kamalaipudhur Taluk and found that the petitioner herein without any qualification or appropriate knowledge in Allpathy medicine had been practising the same; that further during the raid, the petitioner fled away from the spot. Hence, this case.

3. This Court earlier dismissed the petitioner's bail petition twice by stating the following reasons:

Considering the facts and circumstances of this case, gravity of offence, the petitioner herein is alleged to be a quack and he ran away from the clinic while the Joint Director of Health Service Department conducted inspection, taking note of the fact that the investigation of this case is 2/4

pending and if the petitioner is granted anticipatory bail, he would indulge in similar offence and it would hamper the investigation process, hence, this Court is not inclined to grant anticipatory bail to the petitioner. Now, without any change in circumstances, present petition is filed. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 4.Accordingly, this Criminal Original Petition is dismissed. 17.02.2026 sma To
