O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for records relating to the order dated 09.01.2013 made in I.A.No.91/2013 in I.D.No.470/1992 on the file of the first respondent herein and to quash the same and consequently, to issue direction to strike out the petitioner transport concern as improperly added party and to add the KMS Bus Service, Tirupur and Sivakumar Bus Service (Shanthamani), Tirupur as necessary parties in the I.D.No.470/1992 on the file of the first respondent.

2.The learned counsel appearing for the petitioner submitted that the petitioner filed interlocutory application in I.A.No.91/2013 in I.D.No.470/ 1992 before the first respondent seeking to strike out the petitioner as improperly added party and to add the KMS Bus Service, Tiruppur and Sivakumar Bus Service (Shanthamani), Tiruppur as 2/4

parties in I.D.No.470/1992 and the said petition was dismissed and aggrieved by the same, the petitioner filed this writ petition, however, during the pendancy of this writ petition, I.D.No.470/1992 itself was disposed and hence, nothing survives for adjudication in this writ petition.

3.In view of the above, this writ petition is dismissed. However, liberty is granted to the petitioner to challenge the order passed in I.D.No.470/1992, in the manner known to law, if not already challenged. No costs. Consequently, connected miscellaneous petition is closed.
