ORDER

It is represented by the learned Counsel for the petitioner that in view of the dismissal of the suit for default, the instant revision petition has now become infructuous. However, he seeks liberty to file a fresh application as and when the suit is restored to file. He has also made an endorsement to that effect in the Court bundle. Accordingly, the Civil Revision Petition is dismissed as infructuous with liberty to the petitioner to file an impleading application as and when the suit O.S.No.72 of 2010 is restored to file by the Trial Court. Consequently, the connected miscellaneous petition is closed. No costs.
