PRAYER in W.P.No.5769 of 2011: The writ petition has been filed under Article 226 of Constitution of India for issuance of a writ of Certiorarified Mandamus to call for the records in letter/communication dated 28.02.2011 on the file of the 2nd respondent clubbing and rejecting issues pertaining to grievances, House Rent Allowance and transfer of the petitioner and quash the entire proceedings and consequentially forbear the respondents from revising and applying 20% of the HRA for Madurai City to the petitioner. PRAYER in W.P.No.5770 of 2011: The writ petition has been filed under Article 226 of Constitution of India for issuance of a writ of Certiorari calling for the records in the office order No.62/2010-11 in MMTC/CHN/PER/201011 dated 01.03.2011 on the file of the 5th respondent pursuant to office order No.SCI/93/2010 in file No.

MMTC/CO/P (SCI)/01/2010 dated 20.05.2010 on the file of the 3rd respondent and consequential O.O No.12/2010-11 dated 26.05.2010 of the 4th respondent and quash entire proceedings of the 5th respondent pertaining to office order No.62/2010-11 in MMTC/CHN/PER/2010-11 dated 01.03.2011.

ORDER

When the writ petitions were listed for hearing on 21.12.2024, this court passed the following order in both the writ petitions; "In these two writ petitions, the Writ petitioner has challenged the order of transfer and in respect of the auxiliary benefits, while he was in service and by this time, the petitioner would have attained the age of superannuation and therefore, the relief sought for in these writ petitions has become infructuous. However, there is no representation for the petitioner.

List these matters on 07.01.2025 " for dismissal." Even today, when the matters are taken up for hearing, there is no representation on the side of the petitioner. Accordingly, the writ petitions are dismissed for non prosecution. No costs. Consequently, connected miscellaneous petitions are closed.
