PETITION under Section 11 of the Contempt of Courts Act, 1971 to punish the respondents for willful disobedience of the order made in W.P.No. 18782 of 2017 dated 22.12.2017. For Petitioner :

Mr.M.Elumalai, GA Order of the Court was made by T.S.Sivagnanam,J The above contempt petition has been filed to punish the respondents for willful disobedience of the order dated 22.12.2017 in WP.No.18782 of 2017.
2. We have heard Mr.N.Ponraj, learned counsel for the petitioner and Mr.M.Elumalai, learned Government Advocate appearing for respondents 1 to 5 and also one Mr.R.Krishnamurthi, Junior Assistant, Kolathupalayam Town Panchayat, Tirupur District.
3. It is submitted by the learned Government Advocate that the order and direction issued in the said writ petition has been fully complied with, that the fence has been removed and that a mud road has been formed.
4. The small stretch of road should be blacktopped. However, the officials of the respondent, who are present in court, submits that there are lack of funds.
5. In the light of the above, the above contempt petition is closed with a direction to the District Collector, Tirupur District to immediately sanction funds from the contingency account so that the small stretch of land is blacktopped within a period of four weeks from the date of receipt of a copy of this order. Consequently, the connected application is also closed.
