PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to permit the petitioner to pay the marketing fee of Rs.4,36,406/- as demanded by the respondent under Section 24(1) of Tamil Nadu Agricultural Produce Marketing (Regulation) Act, 1987 in 10 equated monthly instalments as per the representation dated 01.10.2012.

ORDER

I have heard Mrs.R.Hemalatha, learned counsel for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondent.

The petitioner seeks a direction to the respondent to consider their representation dated 01.10.2012 to permit them to pay the marketing fee of Rs.4,36,406/- demanded by the respondent under Section 24(1) of Tamil Nadu Agricultural Produce Marketing (Regulation) Act, 1987 in 10 equated monthly instalments.

3. An elaborate counter has been filed by the respondent and the averments set out therein were reiterated by the learned Special Government Pleader. From the last paragraph of the counter, it is seen that the respondent granted permission to https://hcservices.ecourts.gov.in/hcservices/

the petitioner to pay the dues in instalments. In the light of the stand taken in the counter, no further orders would be required to be passed in this writ petition. Nevertheless, it is not clear as to whether the permission granted by the respondent has been taken advantage by the petitioner or not.

4. In the light of the above, the writ petition is dismissed as no further orders are necessary. However, if the amount has not already been paid, in the light of the stand taken in the counter, the petitioner is permitted to pay the marketing fee in 10 equated monthly instalments and first of such instalments shall commence from April 2020. No costs.
