ORDER

The present Criminal Original Petition is filed to quash the proceedings in C.C.No.732 of 2025 on the file of the Judicial Magistrate Court No.IV, Tiruppur, insofar as the petitioners are concerned.

The learned counsel appearing for the petitioners submitted that the petitioners are the parents of the first accused. The main allegagion against the first accused is that he had committed criminal breach of trust along with second accused in the purchase of computers and other than that the amounts have come into the account of the petitioners, there is absolutely no material to show that the petitioners have conspired with the main accused. 3.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the first accused, who is working as System Analyst in the District Court, Tiruppur, conspired with the other accused and by fake bills, cheated the Court to the tune of Rs.11,00,000/- (Rupees Eleven Lakhs). The money trail shows that the amounts have been credited into the accounts of the petitioners. Further, there are materials to show that the petitioners have abetted the first accused in committing the crime. 4.

At this juncture, the learned counsel appearing for the petitioners sought permission of this Court to withdraw this petition and also made an endorsement to that effect. Further, as the petitioners are senior citizens, he sought the indulgence of this Court, to dispense with the personal appearance of the petitioners before the trial Court.

In view of the aforesaid submission and the endorsement made

by the learned counsel appearing for the petitioners qua withdrawal, this Criminal Original Petition is dismissed as withdrawn. Consequently, Crl.M.P.No.2413 of 2026 is closed. However, the personal appearance of the petitioners before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. The petitioners shall be duly represented by their counsel before the trial Court. Accordingly, Crl.M.P.No.2414 of 2026 is ordered. The petitioners are at liberty to raise all the grounds before the trial Court. 12-02-2026 SRM To
