PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ order, or direction in the nature of Writ of Mandamus to direct the respondents 1 and 2 to consider the case of the petitioner for appointment to the post of Hostel Warden at Ramenahalli by taking into account of the letter F.No.8(4)/IP/77 dated 15.01.1977 issued by the Central Government and the priority certificate dated 09.10.1997 issued by the Additional Special Tahsildar (A.D.W.), Arur or to any other suitable post on considering his educational qualification. O R D E R
This Writ Petition has been filed to direct the respondents 1 and 2 to consider the representation of the petitioner for appointment to the post of Hostel Warden at Ramenahalli by taking into account of the letter F.No.8(4)/IP/77 dated 15.01.1977 issued by the Central Government and the priority certificate dated 09.10.1997 issued by the Additional Special Tahsildar (A.D.W.), Arur or to any other suitable post on considering his educational qualification.
2. Today, when the matter is taken up for hearing, there is no representation for the petitioner.
3. Petitioner's land was acquired by the State Government for the purpose for providing house sites to backward community people. At the time of acquisition, the land owners were assured that a member from those families whose lands were acquired will be given preference in employment. The priority certificate was also issued to the petitioner vide proceedings R.C.No.1503/95/B/dated 09.10.1997. However, he has not been sponsored by the respondents for any suitable post. The petitioner has already filed Writ Petition No.20506 of 2009 before this Court and the same was disposed of with a direction to consider his request under priority category within the stipulated time. Even then, the request of the petitioner was not considered. Therefore the petitioner submitted another representation and filed this Writ Petition.
4. On a perusal of the counter filed by the respondents, it revealed that the petitioner's name has been registered under priority category and it is maintained in the fourth respondent's office. However, the petitioner cannot seek employment for the post of Hostel Warden at Ramenahalli though the said post is kept vacant. If the petitioner's name is sponsored by the Employment Exchange, he will be considered for the suitable post and the post will be filled up only by following the existing rules.
5. In view of the above, the prayer sought for by the petitioner in this writ petition cannot be considered. The Writ Petition is devoid of merits and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 01.09.2023 mfa
