Crl.M.P.No.2963 of 2020 Crl.M.P.No.2963 of 2020 in Crl.A.SR.No.6429 of 2020 P.RAJAMANICKAM.J., The learned counsel for the petitioner/appellant has submitted that the petitioner is a victim and hence, he is entitled to file an appeal before the Sessions Court as per the proviso to Section 372 of Cr.P.C., but mistakenly he has filed an appeal before this Court and hence, he requests to grant permission to withdraw this petition with liberty to file an appeal before the Sessions Court. He has also made an endorsement to that effect.

2. Hence, this Criminal Miscellaneous Petition is dismissed as withdrawn with liberty to file an appeal before the concerned Sessions Court.
