Pending appeal, this petition is filed to bring the legal representatives of the deceased 2nd respondent for arraying them as respondents 4 & 5. As per the affidavit filed along with this petition, the 2nd respondent died on 26.12.2019 leaving behind the proposed respondents 4 and 5.

2. Notice caused to the proposed parties. Proposed 4th respondent appeared through his counsel and says no objection . The learned counsel for the other respondents have no objection.

3. In view of the above, this Civil Miscellaneous Petition is allowed.

4. At the request of the learned counsel for the appellant, the Appeal Suit will be taken up for final hearing on 23.02.2021. 08.02.2021 rpl Note: The Registry is directed to carryout necessary amendment in the appeal. G.JAYACHANDRAN, J.
