DECREE: This Second Appeal coming on for hearing on this day upon perusing the Grounds of Appeal, the Judgment and Decrees of the Lower Appellate court and the court of First Instance and the material papers in the suit and upon hearing the arguments of Mr.S.Kalyanaraman, Advocate for the Appellant, and of Mr.C.Jagadish, Advocate for the Respondent, this Court doth order and decree as follows:

i) That the Judgment and Decree of the Additional District Judge(Fast Track Court), Namakkal, dated 13.11.2009 made in A.S. No.69 of 2003, and the judgment and decree dated 14.10.1999 passed in O.S. No.162 of 1997, on the file of the Additional District Munsif, Namakkal be and hereby are upheld; and this Second Appeal do stand dismissed;
