Dated: 06.12.2022

CORAM

THE HONOURABLE DR. JUSTICE ANITA SUMANTH K.A.R.Raja Annamalai ... Petitioner in all W.P.'s Vs 1.The Selection Committee, Hindustan Petroleum Corporation Limited, Coimbatore Retail Region, H.P.House No.18/3, Big Bazaar Street, Coimbatore - 641 001.

2.Hindustan Petroleum Corporation Limited, Rep. by its General Manager, South Zone, Thalamathu Natarajan Building, 4th Floor, No.1, Gandhi Irvin Road, Egmore, Chennai - 600 008.

3.A.Arun Kumar ... Respondents in all W.P.'s Common Prayer: Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to selection list dated 09.11.2010 of the respondents and to quash the same insofar as to the petitioner application for the land comprised in Survey

Nos.431/1, 431/2A at Manjamedu Village, 441/B & 13/1A at Bendarahalli Village all related to Krishnagiri District. (In all W.P.'s) For Petitioner : Mr.S.Siva Shanmugam For Respondents : Mr.M.Vijayan (for R1 & R2) For King and Patridge Mr.V.Raghavachari - R3 COMMON ORDER The petitioner has challenged a selection list for retail outlet dealership of Hindustan Petroleum Corporation Limited at Manjamedu to Puliyur, Krishnagiri District. The basis of the challenge is that the petitioner had enclosed all necessary particulars to evidence his candidature and these documents have not been considered in proper perspective.

2.A grievance petition was filed by the petitioner before the Grievance Redressal Committee of HPCL and on 01.04.2011 and the committee has closed the complaint after investigation as set out under the Dealers' Selection Grievance Redressal Procedure. The reason adduced for rejection of the petitioner's application and also his complaint was that the names, as set out in the application, did not tally with the certificates annexed with the application.

3. The name of the petitioner in the certificates was reflected as R.Raja Annamalai, whereas, in the application, the name was reflected as K.A.R.Raja Annamalai, as in the cause title to this writ petition. As per order dated 01.04.2011 of Grievance Redressal Committee of HPCL, gazette notification evidencing the name of change had not been attached to the application.

4. This Court sees no justification to intervene insofar as there is nothing untoward in the reasoning as set out by the authority under order dated 01.04.2011. I also arrive at this conclusion for the reason that the successful dealer has been managing the business at that venue since 2012 and I find no justification to upset the applecart at this distance in time.

5. The petitioner is always at liberty to apply in response to future calls for dealerships enclosing necessary documents. These writ petitions are thus dismissed. No costs. Consequently, connected miscellaneous petition is closed. kbs 06.12.2022 Index : Yes / No Speaking Order
