M/S. Ar Bachawat Trading v. The State Of Tamil Nadu,

W.M.P.No.13125 of 2016 in W.P.No.34737 of 2015 R.SUBBIAH,J This miscellaneous petition has been filed to direct the 2nd respondent herein to instruct the Food Safety Officer, Vellore Urban, Food Safety and Drug Administration Department, Vellore to forthwith release the consignment containing HANS-CHHAP Tobacco to the petitioner.

2. When the present writ petition came up for admission before this Court on 30.10.2015, this Court has granted an order of interim injunction restraining the respondents from taking any coercive steps against the petitioner by invoking the provisions under the Food and Safety and Standards Act, 2006 and the regulations framed therein by making any seizure of the consignment of HANS CHHAP. Inspite of the said interim order, the goods were seized. Therefore, the petitioner has come up with the above miscellaneous petition.

3. On 25.04.2016, when the matter was taken up for hearing, the learned Government Advocate sought for time to get instructions. Accordingly the matter was adjourned to today (26.04.2016)

4. Today, when the matter is taken up for consideration, the learned Government Advocate by producing the proceedings of the Commissioner of Food Safety dated 25.04.2016 submitted that necessary order was passed by the Commissioner of Food Safety for the release of HANS CHHAP.

5. Since already an order was passed for release of goods, no order need be passed in this miscellaneous petition. Hence, recording the submission of the learned Government Advocate, this miscellaneous petition is closed.
