Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the first respondent to dispose of the petitioner's representation dated 25.08.2018 and cancel the legal heir certificate Ni.Mu.Aa6 No.32567/2008 dated 25.08.2008 issued by the third respondent.

ORDER

This Writ Petition has been filed for a direction directing the first respondent to consider the representation submitted by the petitioner dated 25.08.2018 and dispose of the same.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. A perusal of the representation reveals that it was filed challenging the legal heirship certificate dated 25.08.2008 issued by the third respondent. On receipt of such representation, the first respondent forwarded the same to the concerned Revenue Divisional Officer which is pending for enquiry.

4. In view of the above, the Revenue Divisional Officer, North Chennai, is directed to consider the representation submitted by the petitioner, after issuance of notice to the petitioner as well as the counter party, if any, and give an opportunity of hearing to them, and dispose of the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. No costs.
