O R D E R
This writ petition has been filed for issuance of a writ of mandamus to direct the respondents to revise the petitioner's wages with effect from 01.09.2013 based on the 12th wage settlement dated 13.04.2015 and pay him the arrears of wages payable from 01.09.2013 to 31.12.2013 and difference in gratuity by reckoning 35 years as service period along with the interest @ 12% per annum from the date of entitlement to till the date of actual disbursement.
2. It had been stated that the petitioner had joined the service of the respondents as Special Grade Driver and after attaining the age of superannuation had retired from service on 31.12.2013. It is thus seen that the petitioner seeks the said relief after a period of 11 years. 2/4
3. Let the respondents examine whether the petitioner is entitled for the benefits granted under the 12th wage settlement dated 13.04.2015 and if the petitioner is entitled the respondents shall disburse the same within a period of four months from the date of receipt of a copy of this order. In view of the delay in seeking the relief, it would not be appropriate to further mulct the respondents with payment of interest. However if the amount is disbursed after a period of four months, then interest would be payable from the date on which the amounts were due to be paid @ 6% p.a.
4. With the above direction, the writ petition is disposed of. No costs.
