The petitioner/accused in Crime No.16 of 2023, registered by the respondent police for the offences under Sections 5(n) r/w 6 of POCSO Act, 2012 and Section 506(i) of IPC with reference to an occurrence which took place on 15.11.2023 and FIR registered on 06.12.2023 and he was remanded to judicial custody on 07.12.2023.

2.The petitioner is the stepfather of the victim child. It is stated that when the mother of the victim had gone out, the victim child was sexually assaulted by the petitioner herein.

3.The statement of the victim child has been recorded under Section 164(5) of Cr.P.C., had also been perused by this Court. It is also stated that after completion of investigation, final report had been filed and the same had also been taken cognizance as Spl.S.C.No.15 of 2024 by the Mahila Court, Namakkal.
