The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS, 2023, in Crime No.16 of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 100 kgs of river sand. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are three previous cases pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsels on either side and perused the materials available on record.
6. Considering the nature and gravity of the offence, the specific allegation that the petitioner was involved in illegal quarrying causing damage the ecology, and also taking note of the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 2/4
