C.M.P.No.5001 of 2021 is filed to restore the order of dismissal for nonprosecution dated 09.11.2020 made in C.M.A.No.2760 of 2011.

2.The 1st respondent remained exparte before the Tribunal and hence, notice to the 1st respondent is dispensed with.

3.Though notice has been served on the 2nd respondent/Insurance Company and their name is printed in the cause list, there is no representation for them either in person or through counsel.

4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered as prayed for and C.M.A.No.2760 of 2011 is restored to file.

5.Registry is directed to post the C.M.A. for final hearing on 05.01.2022.
