O R D E R

The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 105 of BNS, 2023 in Crime No.306 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner, being the owner of the land, had illegally drawn electricity from the motor starter box by way of an unauthorized connection and had put up electric fencing around the field in order to prevent cattle from entering the land. It is further alleged that the said electric fencing was executed with full knowledge of causing injuries to the person who accidentally came into contact, and a deceased had accidentally touched it and died. Hence, the case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner and the defacto complainant are closely related. It is further submitted that the occurrence was purely accidental and it is not a case of intentionally causing of death. The learned counsel further submitted that the petitioner is ready to cooperate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (|Crl.side) submitted that the petitioner had put up electric fencing around the field without taking due safety measures and had also drawn electricity by way of an unauthorised connection without the

knowledge of the concerned electricity authorities. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

Considering the nature of the allegations and the submissions made on either side, this Court is of the view that the case is not only with regard to putting electric fencing, but also relates to drawing electricity by way of an unauthorised connection without the knowledge of the concerned electricity authorities and without taking adequate safety measures and resulted in causing death. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
