ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4), 316(2) of BNS in Crime No.613 of 2025, Seeks anticipatory bail.

2. The allegations against the petitioner is that the petitioner induced several persons to invest money in a business scheme by promising high returns and collected a huge sums of Rs.6.18 lakhs from them through various transactions including UPI and IMPS. Thereafter, the accused failed to repay the amount and cheated the investors. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case by the respondent police. He further submitted that petitioner undertakes to cooperate with the investigation and abide by any stringent condition that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that the petitioner along with other accused had collected a sum of Rs.6.18 lakhs from the investors and only repaid a sum of Rs.1.42 lakhs. She further submitted that the remaining amount is yet to be recovered and the investigation in this case is still progressing and she opposed for grant of anticipatory bail to the petitioner.

5. Considering the over tact levelled against this petitioner and the

remaining amount has not been recovered and there is chance of absconding and hampering the investigation, I am not inclined to grant anticipatory bail to the petitioner.
