O R D E R

This Writ Petition has been filed to direct the respondents to take appropriate action, against the 3rd respondent on the representation of the petitioner dated 30.11.2022 and on the letter of the State Election Commission dated 27.07.2022.

2. The petitioner is the Ward counsellor for Ward No.3, in Arumandhai Village Panchayat Union.

3. The case of the petitioner is that, one Mr.Vicky @ Vikraman, the 3rd respondent herein had been elected as the President of the said union and he is in the said post till date. The petitioner would aver that Mr. Vikraman has been indulged in various illegal activities, more particularly, misappropriating the funds of the said Panchayat Union, for his personal benefits and there are several criminal complaints lodged by the villagers against the said Mr.Vikraman and those complaints have been registered as FIRs and the said cases are pending.

4. The learned counsel for the petitioner alleged that the pending F.I.Rs are not mentioned by the R3 and by submitting false declaration to be submitted by the persons to the election, an enquiry had been conducted and the State election commission has directed the first 2/4

respondent to take action, by its letter dated 27.07.2022.

5. The learned Additional Government Pleader takes notice and submitted that the issue will be dealt with in accordance with law. Accordingly, there shall be a direction to the first respondent to dispose of the representation of the petitioner taking note of the direction given by the Election Commissioner vide letter dated 27.07.2022, in the manner known to law within a period of eight weeks from the date of receipt of a copy of this order.
