C.M.P.16448 of 2016 in W.A.S.R.78609 of 2014 S.VAIDYANATHAN, J and MOHAMMED SHAFFIQ, J Even though it is stated by the learned counsel appearing for the contesting respondent No.2/Management of Central Bank of India that there is a delay of 597 days in filing the restoration petition, it is submitted that it is for the Court to decide as to whether the delay has to be condoned or not. No prejudice is going to be caused to the contesting second respondent, if the Writ Appeal itself is going to be decided on merits. Accordingly, the delay in filing the restoration petition, is condoned. This petition is ordered accordingly.
2. Registry is directed to number the restoration petition, if it is otherwise in order and list it in usual course.
