ORDER
The writ petition is filed to direct the third respondent to act upon the proceedings issued by the second respondent in Na.Ka.No.1173/A1/2025 dated 01.08.2025 directing to take action on the complaint made by the petitioner dated 20.05.2025 under the Maintenance and Welfare of Parent and Senior Citizen Act, 2007 within a time frame fixed by this Court.
2. The petitioner made a representation on 20.05.2025 to the District Collector. In the said representation, certain grievances relating to maintenance and also enjoyment of her property and also treating her in an undignified manner by her own daughter and son-in-law are complained of. The petitioner ought to have filed the application before the Revenue Divisional Officer / third respondent herein. It seems that the petition was forwarded to the District Social Welfare Officer, who in turn had forwarded the same to the Revenue Divisional Officer.
3. In view of the nature of relief that is to be granted, the writ petition is disposed of at the admission stage without notice to the fourth and fifth respondents. It is made clear that the Court is not making any findings on the claim of the petitioner or otherwise in the matter.
4. This writ petition is disposed of on the following terms: (i) Within one week from the date of receipt of the web copy of the order, by duly enclosing the earlier representation dated 20.05.2025, let the petitioner make a fresh application addressed to the third respondent categorically mentioning what are the reliefs the petitioner wants and it is for the third respondent to consider the same in accordance with law. (ii) The third respondent shall issue notice to the petitioner as well as the private respondents and any other person who may be interested and decide the same in accordance with law.
(iii) As and when the application is made, let the application be decided as expeditiously as possible, in any event not later than five months from the date of receipt of the application.
(iv) No costs.
