Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 to 4 to cancel the Sub-Division Patta No.3299 relating to Survey No.565/2A2 situated at Bellathi Village, Mettupalayam Taluk, Coimbatore District, by considering the petitioner's representation dated 12.05.2025, remainder dated 20.12.2025 and consequently forbear the respondents from proceeding with any coercive action, including survey and boundary fixation, pending consideration and disposal of the said representation and remainder.

ORDER
This Writ Petition has been filed to direct the respondents 1 to 4 to cancel the sub-division patta No.3299 relating to the property morefully described in the prayer to this writ petition, based on the petitioner's representation, dated 12.05.2025 and the remainder letter, dated 20.12.2025, within a time frame to be fixed by this Court.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 5. Since no adverse Page No.2 of 6
orders are passed against the respondents 6 to 9 in this writ petition, notice to the respondents 6 to 9 is dispensed with by this Court.
3. The grievance of the petitioner in this writ petition is that illegally the respondents 6 to 9 have obtained patta for the subject property. The petitioner seeks for cancellation of the same. The petitioner also claims that even though enquiry was conducted by the 3rd respondent, no final orders have been passed by the 2nd respondent, who is the competent authority with regard to the petitioner's representation seeking for cancellation of patta.
4. No prejudice would be caused to the respondents, if a direction is issued to the 2nd respondent to pass final orders on merits and in accordance with law on the petitioner's representation as stated supra, after hearing the objections of the respondents 6 to 9 or any other third party, whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court.
5. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Court directs the 2nd respondent to pass final orders, on merits and in accordance with law on the petitioner's representation, dated 12.05.2025 and remainder, dated 20.12.2025 seeking for cancellation of sub-division patta No.3299 relating to the property morefully described in the prayer to this writ petition, after giving due consideration of the documents filed by the petitioner and after hearing the objections of the respondents 6 to 9 or any other third party, whom the 2nd respondent deems fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
7. With the aforesaid direction, this Writ Petition is disposed of. No costs.
