Prayer : Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the Respondent to consider the Petitioner's representation dated 14.12.2021 and to act upon the order of this Hon'ble court in W.P. No.10655 of 2009 dated 12.12.2012 and to kindly send the proposal of pension and other benefits and sanctioning and the same in Petitioner's favour. For Petitioner :

ORDER

The learned counsel for the petitioner has submitted that the petitioner was appointed as Conductor in the respondent Corporation in the year 1971. After completion of 22 years of service, due to his ill health, the petitioner had submitted his

voluntary retirement from service in the year 1993. The respondent-Corporation has not sanctioned the petitioner's retirement benefit till date, despite several representations and directions of this Court in W.P.No. 10655 of 2009, dated 12.12.2012. The petitioner has submitted another representation dated 14.12.2021 seeking retirement benefits such as pension etc., , the said representation is also pending before the respondent-corporation without any action. Hence the present writ petition seeking directions to the respondents.

2. Heard both sides and perused the materials available on record.

3. Considering the submissions made by the learned counsel for the petitioner and taking note of the fact that the petitioner is a 75 year old senior citizen, in the interest of justice, this Court is inclined to issue directions to the respondent to consider the representation of the petitioner and pass appropriate orders.

4. Accordingly, the respondents are directed to consider the representation dated 14.12.2021 submitted by the petitioner and pass appropriate orders, as expeditiously as possible, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, the writ petition stands disposed of. No costs.
