Mr.Sathish Parasaran, learned senior counsel appearing on behalf of Mr.M.T.Arunan, learned counsel for the petitioner, on instructions, submitted that the petitioner is giving up the respondents 2 to 4 in the appeal.

2.The submission made by the learned senior counsel is recorded and the learned counsel on record has also made an endorsement to that effect.

3.In view of the same, the respondents 2 to 4 are given up in the appeal.

4.There is a delay of 152 days in preferring the appeal.

5.Mr.D.Balaraman, learned counsel for the 1st respondent has no objection for condoning the delay.

6.Further, being satisified with the reasons stated in the affidavit filed in support of the petition, the delay is condoned.

The petition is ordered.
