ORDER
Today, when the matter is taken up for hearing, the learned counsel for both sides represent that the parties have amicably resolved the dispute among themselves and have entered into Joint Memo of Compromise, dated 23.01.2023, which is produced before this Court and the same reads as follows:- "1. The petitioner is the wife of the respondent and they have a son Master Avyukta who is presently pursuing class 7 in a school at Erode. The petitioner has filed the above CRP under Article 227 of the Constitution of India to strike off the proceedings in H.M.O.P. No.2804 of 2020 pending before the VI Additional Family Court, Chennai. The said proceedings was filed by the respondent herein for dissolution of marriage between the parties herein.
2. During the pendency of the proceedings, the parties forgetting the past pain suffering between them have decided to settle the dispute and differences amicably. Further for concluding the legal proceedings pending before the Hon'ble Court, they have decided to enter into a compromise and file a Joint Memo of Compromise in the above proceedings.
3. The terms of compromise are set out as hereunder: 2/5
(i) The petitioner agrees to live with the respondent at Namakkal and they shall continue and lead their life without any differences. She further confirms that she will not leave the respondent and go to Erode for administration of the preschool from the coming academic year (i.e.) after April, 2023. (ii) The petitioner agrees to bring their son Master Avyukta who is in Erode to Namakka to continue his studies from the coming academic year (i.e.) April, 2023 and the respondent will take care of all their needs. (iii) The petitioner further agrees that she would extend her full support to make their son to understand and live together with the petitioner and respondent in harmony. (iv) The respondent agrees to withdraw the HMOP.No. 2804 of 2020 filed by him now pending before the VI Additional Family Court, Chennai.
(v) That both the parties agree to adhere to the terms of compromise and live peacefully together without any disputes or differences.
In these circumstances, it is humbly prayed that this Hon'ble Court may be pleased to record the compromise and pass necessary orders in terms of the compromise and pass such further or other orders as may deem fit and proper in the circumstances of the case and thus render justice." 3/5
2. Recording the Joint Memo of Compromise dated 23.01.2023 filed by the learned counsels appearing for the revision petitioner as well as the respondent, this Civil Revision Petition is disposed of. The terms of the Joint Memo of Compromise, dated 23.01.2023, shall form part of this order. As agreed by the parties in the Joint Memo of Compromise, the parties shall bear their respective costs. Consequently, connected Miscellaneous Petition is closed.
