O R D E R

Seeking a prayer to accept the surrender of the petitioner and to direct the learned Judge, Fast Track Court II, Egmore to consider his bail application in C.C.No.380 of 2014.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the 1st respondent and perused the materials placed on record.

3. It is represented by the learned counsel for the petitioner that the petitioner was not able to attend the hearing on 29.05.2015, since he was hospitalized and the learned Judge issued non-bailable warrant against the petitioner. Since an offence under Section 138 of the Negotiable Instruments Act is bailable, the relief as prayed for cannot be granted. https://hcservices.ecourts.gov.in/hcservices/

4. Under such circumstances, this petition is dismissed with a direction to the petitioner to surrender before the Trial Court and pray for recalling the warrant.

5. With the above observation, this Criminal Original Petition is dismissed.
