Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the respondents 1 to 3 to furnish copies of electricity misuse assessment and any other statement on the day inspection before proceed further in connection with the misuse of electricity.

O R D E R

When the matter is taken up for hearing, learned counsel for the petitioner submits that by way of subsequent development, a notice dated 30.03.2017 has been issued by the Assistant Executive Engineer, East / TANGEDCO, Tindivanam, indicating the amount payable by the petitioner and providing opportunity to the petitioner. Therefore, the petitioner may be given liberty to give a reply to the notice.

2. The learned counsel for the petitioner further submits that considering the fact that the petitioner is running a school, service connection may be restored.

3. Accordingly, the petitioner is at liberty to give a suitable reply within a period of one week from the date of receipt of a copy of this order and appropriate orders will be passed four weeks thereafter.

4. Though a criminal case is pending, this Court is inclined to consider the request of restoration of service connection, on condition that the petitioner pays a sum of Rs.1,15,000/- (Rupees One Lakh Fifteen Thousand Only) out of the total amount of Rs.2,25,417/-. On such payment, service connection may be restored. This is without prejudice.

5. The writ petition is dismissed with the above observation and direction. No costs. Consequently, connected miscellaneous petition is closed.
