ORDER

The present Transfer Civil Miscellaneous Petition has been filed to withdraw and transfer of F.C.I.D.O.P. No.128 of 2016 from the file of the Family Court, Chengalpattu to the file of the Family Court at Chennai.

2. The wife is the petitioner. She took out this application since she is residing at Ambattur and she is facing livelihood problems due to the lack of financial support from her husband/respondent. She is dependent upon her junior paternal uncle for her survival and hence, on those grounds, she has moved this Transfer Civil Miscellaneous Petition.

3. This Court had issued a notice in the said Transfer application on 04.03.2024. M/s.A.Jasline has entered appearance on behalf of the respondent. Today, on instructions from her client, she reports that her client has no objection for transferring F.C.I.D.O.P. No.128 of 2016 from the file of the Family Court at Chengalpattu to the file of the Family Court at Chennai.

4. In the light of the difficulties faced by the wife/petitioner as well as since the respondent has no objection for the transfer of proceedings, I am inclined to allow the application.

5. Therefore, the proceedings in F.C.I.D.O.P. No.128 of 2016 which is now pending on the file of the Family Court at Chengalpattu is withdrawn and it shall stand transferred to the file of the Family Court at Chennai to be disposed of in accordance with law.

6. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
