PRAYER : Civil Revision Petition filed under Article 227 of Constitution of India, pleased to issue direction to the learned Subordinate Judge, Tiruvallur, to dispose of the A.S.No.1 of 2010 pending on the file of the Subordinate Court, Tiruvallur, within a stipulated period.

This Civil Revision Petition has been filed by the petitioner seeking for a direction to the learned Subordinate Judge, Tiruvallur, to dispose of A.S.No.1 of 2010 within a stipulated period.
2. Learned counsel for the petitioner submitted that the petitioner had filed a suit for partition in S.C.O.S.No.25 of 1990 before the Sub Court, Tiruvallur. Later, the said suit transferred to the file of the District Munsif Court, Tiruvallur and renumbered as O.S.No.95 of 2004 on 08.09.2004 and it came to be decreed on 28.07.2009 granting 1⁄4 share to the petitioner/plaintiff by metes and bounds. Challenging the same, the first defendant/G.Nagaraj has preferred an Appeal Suit before the learned Principal District Judge, Tiruvallur, in A.S.No.1 of 2010 against 8 / 11
the petitioner/plaintiff and other respondents, who are the purchasers of the property and made ex parte. Since the first defendant died, his sons, who are respondents 144 & 145 herein, have been brought on record and subsequently, the Appeal Suit transferred to the file of the Subordinate Court, Tiruvallur and it is still pending for the past 14 years. He further submitted that the petitioner is a senior citizen aged about 75 years and more particularly in the evening of her life. Due to the pendency of the appeal, the petitioner is unable to enjoy the fruits of the decree dated 28.07.2009. Therefore, the present Civil Revision Petition has been filed seeking for a direction to complete the appeal as early as possible.
3. Heard the learned counsel for the petitioner and perused the materials available on record.
4. On perusal of records, it is seen that the suit filed by the petitioner/plaintiff was decreed in the year 2009 and the appeal suit filed by the first defendant is pending from 2010 on the file of the Subordinate Court, Tiruvallur.

In view of the above, this Civil Revision Petition stands allowed with a direction to the learned Subordinate Judge, Tiruvallur, to dispose of the Appeal Suit in A.S.No.1 of 2010, as expeditiously as possible, preferably, within a period of nine months from the date of receipt of a copy of this order.
