ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 and 430 of IPC and Section 21(5) of Mines and Mineral ( Development & Regulation) Act, 1957 in crime No. 107 of 2021 on the file of respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner had transported one unit of sand without proper licence. Hence, the respondent police registered the case against the petitioner.
3. The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional public prosecutor would submit that the petitioner is a habitual offender and there are two previous cases pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the fact that the petitioner is a habitual offender and there are two previous cases pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
