ORDER : The Court Made the following order :- Apprehending arrest in connection with a case in Crime No.254 of 2017 on the file of the respondent police for the offences punishable under Sections 457(ii) and 380(ii) IPC, relating to theft of idols in Shri Venogopal Swami Temple at Sampathrayanpetti Village, the petitioner has come up with the present petition seeking anticipatory bail.
2.This Court, by order dated 27.02.2018, directed the petitioner to appear before the IGPs Special Camp Office, Race Course Road, Subramaniapuram, Trichy-20, from 01.03.2018 to 05.03.2018 between 10.30 am and 5.30pm, for investigation.
3.Today, when the matter is taken up for consideration, the learned counsel for the petitioner submits that the petitioner has duly complied with the order of this Court dated 27.02.2018. Therefore, the learned counsel seeks anticipatory bail to the petitioner.
4.On the other hand, the learned Government Advocate (Crl.Side) submits that the case in Crime No.254 of 2017, in which, the petitioner was implicated, is pending on the file of the respondent police and hence, the custodial interrogation of the petitioner is very much essential for completion of the investigation in the said case.
5.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side and also taking note of the fact that the co-accused were already ordered to be released on bail, this Court is inclined to grant anticipatory bail to the petitioner.
6.Accordingly, the petitioner is ordered to be enlarged on bail, in the event of arrest or on his appearance within a period of two weeks from the date of receipt of a copy of this order before the learned Judicial Magistrate, Arakkonam, on the following conditions:- (i)the petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties each for a like sum to the satisfaction of the arresting Officer or to the satisfaction of the learned Judicial Magistrate, Arakkonam; and (ii) he shall report before the Deputy Superintendent of Police, Arakkonam daily between 10.00am and 5.00pm for a period of one week and thereafter, as and when required for interrogation. -sd/- 06/03/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
