(Crime No. 316/17) Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to set aside the condition of the petitioner/accused to deposit sum of Rs.40,000/- (Rupees Forty Thousand Only) imposed in Crl.MP.No.2662 of 2017 on 28.04.2017 by the learned Principal Sessions Judge, Villupuram, Villupurpam District.

ORDER
This Criminal Original Petition has been filed to modify the condition dated 28.04.2017, imposed by the learned Principal Sessions Judge, Villupuram, Villupurpam District in Crl.MP.No.2662 of 2017.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.
3. It is the case of the petitioner that he has filed a petition in Crl.MP.No.2662 of 2017 before the learned Principal Sessions Judge, Villupuram, seeking bail and the learned Principal Sessions Judge, Villupuram, by an order dated 28.04.2017, granted bail to the petitioner on certain conditions. One of the condition is that the petitioner should deposit a sum of Rs.40,000/- as cash security before the lower https://hcservices.ecourts.gov.in/hcservices/
Court. Hence, seeking modification of the said order, the petitioner has come up with present petition.
4. The learned counsel for the petitioner submitted that the petitioner is not able to deposit such a hung amount of Rs.40,000/-, since he is a daily bread winner.
5. The learned Government Advocate (Crl. Side) has no serious objection to modify the said condition imposed on the petitioner.
6. Under such circumstances, the condition imposed on the petitioner in Crl.MP.No.2662 of 2017 dated 28.04.2017 is modified to the effect that the petitioner shall deposit a sum of Rs.25,000/- before the lower Court, instead of Rs.40,000/-. Rest of the conditions imposed by the learned Principal Sessions Judge, Villupuram shall remain the same.
With the above modification, this Criminal Original Petition is ordered.
