The prayer sought for in the present petition is to club both the cases in S.C. No. 217 of 2009 and S.C.No. 34 of 2005 on the file of Additional Sessions Judge, Salem.

2. It is submitted that in the proceedings in SC No. 217 of 2009, the defence witnesses A5 and A20 have already been examined and in the proceedings in S.C.No. 34 of 2015, the case is at the stage of examination of Defence witnesses. In these circumstances, I am of the view that, at this stage, it would not be appropriate to club both the cases. Hence the present Criminal Original Petition stands dismissed. 28.07.2017 Index:Yes/No ak
