PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the learned Judicial Magistrate, Tirukoilur to dispose the case in C.C.No.105 of 2017 in Expedite the trial as possible within a time frame fixed by the Hon'ble Court deem fit.

O R D E R

This petition has been filed by the Accused No.2 to direct the learned Judicial Magistrate, Tirukoilur to dispose of the case in C.C.No.105 of 2017 at early.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioner has submitted that the petitioner is facing trial for the alleged offences under Sections 294(b), 323, 354(b), 506(1) of IPC in C.C.No.105 of 2017 on the file of the Judicial Magistrate, Tirukoilur. He further submitted that in the said case, the petitioner has been arrayed as accused No.2 and apart from the petitioner, three more persons also arrayed as accused in the said case. He further submitted that all the accused have been regularly appeared before the trial Court but the trial Court is routinely adjourning the case and therefore, he prayed to direct the trial court to dispose of the aforesaid case at early. https://hcservices.ecourts.gov.in/hcservices/

The learned Additional Public Prosecutor appearing for the respondent has submitted that the petitioner and others are facing trial for the alleged offences under Sections 294(b), 323, 354(b), 506(1) of IPC. He further submitted that totally 8 witnesses have been cited on the side of the prosecution and now the case is posted to 07.04.2020 for examining the witnesses and hence he requests to fix a reasonable time for disposing of the aforesaid case.

5. Considering the fact that the above said case is pending from the year 2017 and all the accused are appearing regularly, the trial Court is directed to advance the hearing from 07.04.2020 after giving notice to both sides and fix a fresh date for examining the witnesses and dispose of the said case within a period four months from the date of receipt of copy of this order.

6. With the abovesaid directions, this Criminal Original Petition is disposed of.
